How California Calculates Child Support
California uses a statewide uniform guideline formula to set support amounts, and courts are required to follow it in nearly all cases. The formula’s two primary inputs are each parent’s net disposable income and the percentage of time each child spends with each parent, known as the timeshare. Expressed formally: CS = K(HN − (H%)(TN)), where CS is the support amount, HN is the higher earner’s net monthly disposable income, H% is that parent’s custody timeshare, and TN is both parents’ combined net monthly disposable income.
Beyond those core inputs, courts also factor in wages, bonuses, self-employment income, health insurance premiums, work-related childcare costs, and uninsured medical expenses. A judge can depart from the guideline amount only in limited statutory circumstances. Courts and attorneys run these figures through Judicial Council-approved calculator software; a public estimator is also available at childsupport.ca.gov.
Child Support Services We Offer in Glendale
We represent both paying and receiving parents. Whatever your position in a child support dispute, we work to reach a fair resolution through negotiation and, when necessary, through court proceedings.
Establishing a New Order
If no order exists yet, we help you establish one. Parents who were never married must first establish parentage before a California court can enter a child support order. Under California Family Code section 3901, support orders generally remain in effect until a child turns 18, or 19 if the child is unmarried, a full-time high school student, and not self-supporting.
Pursuing Back-Owed Support
When the other parent has fallen behind, we pursue collection of unpaid arrears on your behalf. Under California Code of Civil Procedure section 685.010, unpaid child support accrues 10 percent annual interest, so the total owed grows the longer it goes uncollected.
Modifying an Existing Order
Life changes, and support orders can change with it. We assist clients in filing for modifications when circumstances have shifted since the original order was entered.
When & How to Request a Modification
California courts retain ongoing authority to modify child support at any time. To obtain a modification, the requesting parent must show a material change in circumstances since the original order. Common triggers include job loss, a significant income change for either parent, a shift in the custody timeshare, or changes in health insurance and childcare costs.
Timing matters. A modification takes effect from the date the request is filed with the court, not from the date circumstances changed. Waiting can mean leaving money on the table or continuing to pay at a rate that no longer fits your situation.
Enforcing a Child Support Order in Glendale
When a parent stops paying, California law provides several enforcement tools. A wage garnishment operates as an automatic income withholding order, pulling support directly from the paying parent’s paycheck before it reaches them. Additional mechanisms available under California law include interception of state and federal tax refunds, suspension of driver’s and professional licenses, bank account levies, property liens, and credit reporting of arrears.
A judge can hold a non-paying parent in contempt of court when non-compliance is willful, which can result in fines and up to five days in jail per count. In certain circumstances, willful failure to pay may also be prosecuted as a misdemeanor or felony. Our child support attorneys in Glendale can assess your situation and recommend an enforcement approach based on your circumstances.
